This study examines the concept of naturalis ratio in Canon 1091 §1 of the 1983 Code of Canon Law concerning the prohibition of incestuous marriage. Through a philosophical-legal approach and historical hermeneutics, the research reveals that naturalis ratio is not a static norm, but a dynamic and contextual principle. It integrates biological, anthropological, theological, and psychological dimensions into the Church’s legal reasoning. A comparative analysis between the 1917 and 1983 Codes of Canon Law indicates a paradigm shift from a neoscholastic legalistic framework to a more humane and contextual hermeneutic-anthropological approach. The novelty of this study lies in its proposed model of contextual interpretation of naturalis ratio, which allows natural law to remain rooted in universal moral principles while being open to scientific developments and contemporary pastoral needs.
